EMPLOYMENT LITIGATION PRACTICE

Carmen D. Caruso's employment practice includes the trial and appeal of claims for:

- Employment Discrimination on the grounds of gender, race, age or disability, including ground-breaking "glass ceiling" claims of gender discrimination at the executive level.
- Retaliatory Discharge.
- Sexual Harassment.
- Whistle blowing.
- Breach of written employment and severance contracts.
- ERISA violations (for example, discharge to prevent the vesting of retirement benefits).
- The enforcement of non-compete and no-solicitation clauses.
- Theft of trade secrets.
- First Amendment claims by public employees.
- Breaches of fiduciary duties by employees, officers and directors.

Mr. Caruso has represented employers, and also highly selected employees (plaintiffs), usually in cases of executive or professional employment.   He has obtained confidential six figure settlements for female executives on the basis of gender discrimination.   He has also won a significant victory in the United States Court of Appeals for the Seventh Circuit on behalf of a female manager who was the victim of a glass ceiling, a phony Reduction In Force (RIF) and improper gender stereotyping as detailed in a linked case study.

Mr. Caruso also counsels employers and employees on the terms of their employment (and severance) agreements, and on the avoidance of disputes.

Mr. Caruso is qualified to arbitrate employment disputes arising in the securities industry on behalf of the NASD.
